Introduction

Welcome to labeltrackr ("labeltrackr," "we," "us," or "our"). By accessing or using our services, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

1. Use of Our Services

Some parts of our services require you to take legally binding steps like signing contracts. You need to be over the legal age limit in your country of residence to use our services. By using our services you ensure that you are over the legal age limit or that you are appropriately involving a legal guardian to take responsibility for you.

2. Account Registration

In order to access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3. Subscriptions, Upgrading, Downgrading

If you subscribe to any subscription on our site you are able to unsubscribe or change your subscription as a self service functionality in the settings of your label account. All benefits of the subscription will continue to be available until the next billing period. If you choose to upgrade your subscription, all additional benefits will become available as soon as possible.

You agree to let the third party provider stripe handle subscriptions and billing for us. For more information on how we work with third party services, please visit our privacy policy.

3. User Content

You retain ownership of any content you submit, post, or display on or through our services unless specified otherwise in a contract ("User Content"). By submitting, posting, or displaying User Content, you grant us the right to view and review any submitted data and assets, so that we are able to improve and run labeltrackr. Other users and record labels on the site may view, download and share the content you uploaded with appropriate parties.

Take note that files on labeltrackr may only be hard to find but not always protected. Ensure that documents you upload are not able to cause critical damages if they were to be published. We also retain the right to remove files from our platform if they violate our terms of service or under circumstances where it is necessary to further improve our service.

Content other users have uploaded still remains within their ownership unless specified otherwise in a release contract. You ensure that you will not missuse your access to those assets in any way.

You agree that your content may be stored and processed in countries outside of your own. Data of all users may be transferred internationally, including into and outside of the EU and / or the US.

4. DocuSeal and Electronic Signing

Electronic signatures and signature requests offered by labeltrackr are handled by the third party DocuSeal. DocuSeals sigantures are certified for the eIDAS simple signature standard.

Simple electronic signatures are the weakest of the three signature standards (simple, advanced, qualified). DocuSeal aims to make simple electronic signatures more trustworthy by employing industry standard document signing technology in combination with metadata and a public audit trail, but does not guarantee the signatures to hold up as part of important legal issues.
Simple electronic signatures mainly suffer from trust in the party that signs the documents, since they remain in charge of when to sign what document. Higher signing standards solve this issue by involving certificates from legally trusted sources among other things.

You aknowledge the short comings of the eIDAS simple electronic signature standard and aggree not to hold labeltrackr or DocuSeal accountable for any damages caused by improper usage of the inbuilt signing feature.

If you need higher signing standards for your usecase or company, please contact us at info@labeltrackr.com, so we can talk about implementing providers of advanced and qualified signatures aswell. For now, simple signatures strike a nice balance between cost and benefit for our main userbase.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws or regulations.
  • Infringing the rights of others, including intellectual property rights.
  • Uploading, transmitting, or distributing any viruses, malware, or other malicious code.
  • Interfering with or disrupting our services or servers.
  • Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity.

6. Intellectual Property

All intellectual property rights in our services, including but not limited to trademarks, copyrights, and patents, are owned by labeltrackr or its licensors. You may not use our intellectual property without our prior written consent.

7. Termination

We may suspend or terminate your access to our services at any time, with or without cause, and without prior notice or liability.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free.

9. Limitation of Liability

In no event shall labeltrackr or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of our services.

Documents signed through labeltrackr's integration of the DocuSeal platform aim to provide additional safety in the verification of truth, but do not guarantee complete legal safety. Labeltrackr expects all users to know of and keep in mind the shortcomings of the simple eIDAS signing standard that DocuSeal provides and will not be held liable for damages caused due to insufficient qualifications of the electronic signing algorithm.

10. Indemnification

You agree to indemnify and hold harmless labeltrackr and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from or related to your use of our services or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on this website or our social media channels.
